Prosjektet vi foreslår vil studere hvorledes internasjonale menneskerettighetsavtaler ble forventet å påvirke lokale og nasjonale politiske prosesser, og også hvorledes de har gjort det i praksis. I kjernen av dette ligger både strukturelle elementer med  hensyn til hvorledes Grunnloven og etablert praksis la rammer for forholdet mellom nasjonal og internasjonal rett, men også hvorledes sentrale politikere, embetsmenn og aktivister har oppfattet at internasjonal rett er relevant for rettslig og politisk pr aksis i Norge. Prosjektet har en hovedvekt på Norge, men har også betydelige komparative elementer. Framvekst av internasjonal rett og dennes betydning for nasjonale politiske prosesser settes inn en internasjonal historisk kontekst der vi spør om hvordan  økt internasjonal samarbeid i tiden etter 1945 har påvirket marginaliserte gruppers nasjonale politiske gjennomslagskraft. Prosjektet vil ha bred interesse særlig i samiske miljøer, i Finnmark og andre områder som er berørt og også i nasjonale politiske  miljøer. Videre vil de allmenne og komparative perspektivene være relevante for det pågående arbeidet med å revidere Grunnlovens menneskerettighetsbestemmelser. Prosjektet har tre hoveddeler. Det første er en empirisk, arkiv- og intervjubasert studie av N orges bidrag til framforhandlingen av Den internasjonale arbeidsorganisasjonen (ILO) sin konvensjon nr 169 Om urfolks rettigheter (1989). Dette delprosjektet inkluderer publiseringen av en vitenskaplig artikkel samt en internasjonal arbeidskonferanse om i nternasjonale menneskerettigheters betydning for pågående politiske prosesser. Den andre er en komparativ arkivbasert studie av Norges og USAs bidrag til å skape et internasjonalt menneskerettighetssystem, med en hovedvekt på årene 1940-1954. Tilslutt har  prosjektet en bred og betydelig formidlingskomponent knyttet til Institutt for arkeologi, konservering og histories 2014 prosjekt 'Norgeshistorie på nett'.

Tillegg fra søknad 227947:

Tilleggsbevilgningen søkes for å kunne gjennomføre et muntlig histori eintervju med Ole Henrik Magga  etter en metode utviklet av Forum for samtidshistorie (FoSam) ved UiO. Vi vil uansett intervjue Magga i forbindelse med vårt delprosjekt om ILO konvensjon 169. En hovedbegrunnelse for endre metode er at intervjuet kan bli e n del av Riksarkivets samling og være tilgjengelig for forskere og allmenheten, se http://www.arkivverket.no/Aktuelt/Nyhetsarkiv/Politikk-fra-innsiden.
I alt 41 sentrale samfunnsaktører ble intervjuet av FoSam som ledd i dets prosjekt om endringer i norsk  politisk kultur etter 1975. Ingen av disse var samiske. I denne perioden skjedde imidlertid store endringer i forholdet mellom den norske og samiske befolkning og mellom den norske stat og samene.  Et intervju med Magga vil dekke sentrale tema i norsk og  samisk politisk historie de siste femti-seksti år. Dette inkluderer Altasaken, opprettelsen av Sametinget, henvisningen til samene i Grunnloven og framforhandlingen av Finnmarksloven.  Vi vil også berøre samisk internasjonal aktivisme og betydningen av i nternasjonale menneskerettighetsinstrumenter for samiske politiske krav i Norge. Intervjuet vil være et viktig tillegg til Riksarkivets samling. 
FoSam-intervjuene har resultert i lydopptak på 3-6 timer/70-100 sider redigert tekst. Intervjuet med Magga fo rventes å få et omfang på 5-6 timer. Metoden er beskrevet i vedlegget.
En endring i intervjuform vil utløse ekstrakostnader. Det må utarbeides en dokumentasjonsmappe som vil ligge til grunn for intervjuet. I tillegg må intervjuet transkriberes og redigere s. Vi ønsker å bruke ekstern kvalitetssikring og én ekstern intervjuer i tillegg til Vik og Semb. 
Intervjuobjektet kan velge å klausurere hele eller deler av materialet. Et flertall av de intervjuede har imidlertid valgt å godkjenne rask publisering av h ele eller deler av intervjuet på Riksarkivets nettside. Vi ønsker å intervjue Magga i mars 2013 og ferdigstille intervjuet i september.

Det globale i det lokale og det lokale i det globale - konstitusjon, menneskerettigheter og interessekamp.

The one day of constituional debate in 1814 gives us a unique intake to study changes both at the macro-political and the micro-political levels. On the one hand, the debate crystallises paternalist, loyalist and democratic positions, among civil servants  who were transforming from being archetypical middle-men of empire to a class of increasingly self-aware leaders of the country. On the other, it also highlights the quotidian practices that enabled such change. The suggested project thus aims at studyin g the change from empire to suzerainty through three different loci. At the macro-level, we seek to establish the Dano-Norwegian monarchy as one of many empires of the day, and Norwegian independence in 1814 as one example of imperial dissolution. At the  micro-level, we study how this transition was interconnected with the growing self-awareness and changing practices of the Norwegian civil servants. Tying the levels together, at the meso level, we study how changing conceptualisations of external affairs  and Norway's relations with the world around it opened conceptual space for suzerainty and gradual democratisation.

It is important to acknowledge that this is a social science project rather than an historical project. The vast body of literature on Sc andinavian history from the period will be mined and reassessed through social science lenses as a means, on the one hand, of bringing new aspects of the historical period around the Constitution to light and on the other of extending our theoretical unde rstanding of different polities, state formations and the mechanisms behind them. The project is an extension of ongoing research, and will rely on first-hand sources and on second-hand sources in the Scandinavian languages and English. We will rely on de tailed readings of key works of central authors, journals and newspapers of the day and Storting records. Content analysis and network analysis, both quantitative and qualitative, will be used.

Fra tilleggssøknad 216999:

I forbindelse med vårt prosjekt Manning the State, søker vi  om midler til deltakelse på seminar i Danmark 30.-31. januar 2012, samt i denne  forbindelse å avholde seminar i København 1. februar.  

Vi ønsker å koble oss opp til det danske 1814 nettverket gjennom å bidra på en av konferansene de avholder. Konferansen er særdeles relevant for vårt prosjekt, da den omhandler ?Norge, hertugdømmer ne og kolonierne - 1814 og eftervirkningerne?. 

Vi ønsker å kombinere vår deltagelse i 1814 nettverkets konferanse, med et prosjektseminar i København i etterkant. Vi vil her presentere de første artikkelutkastene, som vil raffineres videre etter innspil l fra referansegruppen for presentasjon på en internasjonal konferanse i San Diego senere samme vår. Dette seminaret vil dermed være første skritt i prosessen frem mot de første artiklene.

Dette kombinerte tiltaket er dermed tuftet på både samarbeid mell om prosjektene i GRUNNLOV og 1814 nettverket, og faglig assistanse iht. spesifisering av referansegruppe i den opprinnelige prosjektsøknaden.

MANNING THE STATE:  The Danish Empire, Its Norwegian Civil Servants and the Making of the 1814 Constitution

The year 2014 marked the 200 years anniversary of the Norwegian Constitution, which was the start of the new and independent Norwegian state. This book discusses themes that have been in the shadows during the anniversary; the relations between the Constitution and the Norwegian welfare state. The main theme of the book is the gradual development from 1814-2014; the distance and different stages from liberal rule of law to a social democratic welfare state. The concept "welfare state" was unknown in 1814, and the 1814-constitution did not mention anything about social rights. However, Norway is today a developed welfare state, several times proclaimed as one of the best countries in the world to live in. This is so despite the fact that the Constitution has not been a protector of welfare services. The research project has been driven by a curiosity related to the question whether the Constitution still has played a role for the development of the welfare state, and, if so, which role, and how? Are there any relations at all? The project started out with a hypothesis that there must be some kind of relations between the Constitution and the welfare state, but that these are not necessarily evident.
Early on we discovered one particular relation or «red thread», which connects the past and the present, namely the principle of equality. This principle is expressed in the 1814-Constitution, and it is one of the main values of the welfare state. The ideas of popular sovereignty, equality and human rights provide links between the 1814 Constitution and the modern Norwegian welfare state.  It is reason to believe that the ideas of popular sovereignty, equality and human rights have influenced the Norwegian society, and thus that the Constitution has had some impact on the development of the welfare state.  
The book seeks to illustrate the gradual development and the «long lines» from autocracy, rule of law, democracy and to the modern welfare state, which are overlapping stages. In addition, the book provides a cross-cutting theme related to the Constitution as a basic "social contract" between the state and the citizens. A central question raised in the book is whether the Constitution provides an adequate expression of the modern Norwegian social contract.  
Section 2 of the Constitution - previously known as the "Judeprovision" - was the most famous and disputed section of the 1814 Constitution. The history of this provision, and its changes during 200 years, is also a story about Norwegian social development and outlook on foreigners. The historical debates about the "Judeprovision" in the Constitution provides an interesting backdrop for today´s debates about immigration, integration and exclusion.  
The «long lines» from 1814 to 2014 illustrate great differences but also the existence of important ties between the past and the present, and that the Constitution plays a role in connecting the past and the present. An important question today is what role the Constitution should play in the protection of essential welfare goods and marginalized groups and in the protection against a future possible destruction of the welfare state.  
In May 2014, the human rights protection in the Constitution was upgraded. Inter alia, new provisions on economic and social rights were included and thereby given constitutional protection: Children´s right to economic -, social - and health security, the right to education and the right to social assistance.  Protection of health and the right to necessary health care (for adults) were not included, which is open to criticism in light of the long tradition (from the 19th century) of public health protection in Norway. Although the new provisions in the Constitution do not change the content of Norwegian law, they are still significant: The Constitution, understood as a basic "social contract" between the state and the people, now provides a more complete expression of the requirements and the expectations that exist between state and citizens in the modern Norwegian state.      


This project explores the influence of the Norwegian Constitution on the notion of citizenship, and in particular the legal and political interplay between the Constitution and the development of the Norwegian welfare state. The notion of a social contrac t is of particular interest: What kind of social contract was established between the Norwegian state and its citizens with and by the 1814 Constitution? Might the egalitarian way of thinking, as expressed in the 1814 Constitution (prohibition of future l ordships, baronies and other aristocratic institutions) be seen as an important stepping stone for the development of the Norwegian welfare state and model of citizenship? The 1814 Norwegian Constitution contained provisions forbidding Jews, Jesuits and m onk orders access to the kingdom, thereby signifying a need to protect Norwegian society against particular foreign influences. What is the relationship between this protectionist attitude, egalitarianism and current modern welfare state policies and regu lations when it comes to immigrants?  

Norway has developed a strong welfare state built on universal social benefits. However, social rights are not protected as such in the Constitution. Thus, it seems that the Norwegian Constitution is not representat ive of the basic values and principles that characterize Norwegian society today. Based on this and other observations, the project will examine the relevance of the Norwegian Constitution for today´s national and international legal debates, and analyze  the Norwegian Constitution in a comparative perspective with regard to content, structure and aims. Our ambition is to examine the Constitution in three contexts: The modern welfare state, international human rights and comparative law. All these contexts  are essential for the understanding of the Norwegian Constitution and its status as the normative framework and legal infrastructure in Norway.

Tillegg i forbindelse med søknad nr. 208381:
Symposiet har til føremål å kombinere grunnlovsdebatt for eit allmeint publikum med rettsvitskapeleg gransking av aktuelle grunnlovsspørsmål og er det fyrste av tre slike planlagte satsinga r frå Det juridiske fakultet fram mot 1814. Tema for den fyrste dagen av dette fyrste symposiet er «Grunnloven og menneskerettighetene 1814-2014». Bakgrunnen er at Stortingets menneskerettsutval leverer sitt framlegg til revisjon av menneskerettane i Grun nlova i januar 2012. Innstillinga frå Menneskerettsutvalet vil bli presentert for eit allmeint publikum og deretter, truleg for fyrste gong, diskutert av leiande norske fagpersonar (sjå vedlagt program).
På andre dagen av symposiet blir det rettsvitskapel ege perspektivet frå spørsmålet om revisjonen av menneskerettane i Grunnloven utvida til å omfatte andre aktuelle forfatnings-spørsmål. Dagen opnar, med forankring i diskusjonen frå fyrste dag, med ein presentasjon og diskusjon av dei sentrale forskingssp ørsmåla i «Grunnloven og velferdsstaten» som er fakul-tetets prosjekt under NFRs grunnlovssatsing. Programmet held vidare fram med tre tema som går på demokratiske utfordringar og dilemma i det norske samfunnet, jf. hovudtema 2 i den faglege planen for Gr unnlovssatsinga. Konkret er det den konstitusjonelle utviklinga i kom-parativt perspektiv, spørsmålet om grunnlovsfesting av kommunalt sjølvstyre og den for-fatningsrettslege stillinga til Noregs Bank som blir sett på agendaen i dette fyrste av tre planla gde symposium. 
Symposiet tek sikte på å nå ut til eit allmeint publikum med diskusjonen om revisjonen av menneskerettane i Grunnloven. I den breiare diskusjonen av demokratiske utfordringar og dilemma knytt til forfatninga på andre dagen av symposiet, er  målet fyrst og fremst å generere rettsvitskapeleg forfatningsforsking av høg kvalitet innanfor område som i liten grad blir handsama under hovudprosjekta i NFRs Grunnlovssatsing.

Tillegg i forbindelse med søknad nr. 227379:

Symposiet har til føremål å  kombinere grunnlovsdebatt for eit allmeint publikum med rettsvitskapeleg gransking av aktuelle grunnlovsspørsmål og er det andre av tre slike planlagte arrangement frå Det juridiske fakultet fram mot 1814. Arrangementet er programmert etter same lest som  i fjor då meir enn 100 forskarar, byråkratar, studentar og politikarar fann vegen til symposiet. Tema er i år «Grunnlov, likskap og demokrati» og symposiet vil under denne tittelen løfte fram så vel rettshistoriske som dagsaktuelle problem som Grunnloven  tek sikte på å regulere.

Første del av symposiet har i år eit rettshistorisk perspektiv og tek utgangspunkt i likskapstanken frå 1814. Likskapstanken og prinsippet om folkesuverenitet vil her bli sett inn i ein historisk kontekst. Ved hjelp av rettsforsk arar og historikarar skal vi, i dialog med publikum, trekkje linjer bakover og framover i tid. 

Andre del av symposiet har eit dagsaktu

Constitution, welfare state and citizenship

Verdenskongressene i konstitusjonell rett arangeres hvert 4. år av International Association of Constitutional Law (IACL). Kongressene har gjerne 500-600 deltagere (både etablerte forskere og rekrutter) og tilbyr et prestisjefyle forum for forskningsformi dling og -debatt i konstitusjonell rett (statsforfatningsrett). Det er en selvfølge at viktige deler av programmet legges opp rundt temaer som er relatert til det norske 200-årsjubileet. 
Ideen om å legge kongressen i 2014 til Oslo er klarert med IACL på  en slik måte at en invitasjon fra UiO utvilsomt vil bli akseptert. En invitasjonen forutsetter imidlertid at den nødvendige sikkerhet kan etableres for at de økonomiske og praktiske vilkårene vil la seg tilfredsstille. Dette bør så vidt mulig skje før eks ekutivkomitémøtet i IACL i Paris 9. oktober og senest i tide for neste verdenskongress 5.-10. desember 2010, der den planlagte invitasjonen formelt må fremmes og aksepteres av IACL. 
For å få til dette er vi avhengige av å kunne subsidiere kongressen med  et betydelig beløp. Norge er (kjent som) et høykostland, og det er viktig at kongressen ikke prises slik at forskningsrekrutter samt deltagere fra fattige land i praksis blir utestengt. Slik budsjettet foreløpig er satt opp, vil det bli krevet betydelig h øyere deltageravgift enn normalt (200 euros). Kongressen kan ikke fullfinansieres på denne måten uten at prisen gå sterkt utover deltagelsen. 
Siden få andre offentlige finansieringskilder relevante, vil den vesentlige del av finansieringen måtte komme fr a GRUNNLOV-programmet. Det angitte maksimalbeløpet for støtte til arrangementer fra NFR (NOK 500 000) er ikke tilstrekkelig; anvendt på et arrangement av nasjonal interesse og av såpass ekstraordinær karakter virker rammen dessuten vilkårlig. Dersom en ti ldeling likevel begrenses til dette beløpet, vil vi være avhengige av å klare å samle støtte fra flere eksterne kilder. Det er i beste fall usikkert om dette lar seg gjøre innenfor nevnte tidsramme.
