HydroConnect focuses on the connectivities afforded by hidden, underground fresh water that surfaces along the coastlines of islands lacking accessible, perennial fresh water. It explores how Austronesian-speaking seafarers transformed such freshwater ‘seeps’ into wells throughout the South China Sea and Indo-Pacific, affording sea-routes around these well networks. Thus, HydroConnect breaks with the tendency in the social sciences and historiography to analytically privilege oceans or navigable rivers as vectors of global connections and history-making.  With the innovative concept of hydroconnectivities – human connections afforded by fresh water access – HydroConnect develops a novel theoretical framework linking the terrestrial and the aquatic through comparative historical ethnography of Austronesian speakers’ Indigenous knowledge, which has crossed oceans and flowed down generations, travelling between different groups of people. Deploying a cyclical tidalectic methodology transcending anthropology, archaeology and geology, it breaks new methodological and theoretical ground for conceptualising global history through hydrological connectivities across these chains of island worlds in different oceans.  First, it studies how this travelling Indigenous knowledge enabled hydroconnectivities that opened up sea routes and integrated fresh water, well infrastructure, and ecological and social exchanges across immense oceanic spaces in the past. Second, the project maps and theorizes how present-day descendants and successors of Austronesian-speaking seafarers benefit from vernacular hydrological knowledge of underground freshwater seeps. Thus, it advances analogical knowledge for tackling groundwater depletion to enable past-informed and future-oriented water policies for the sustainable management of the Earth’s aquifers. 

Global Hydroconnectivities beyond Oceans, Seas and Rivers

Health, European Muslims and Gender: Medical Authority and Assisted Reproductive Technologies in Sunni Islam

Infertility is estimated to affect an average of 14% people worldwide. It is an issue that affects equally both men and women, although it is often associated with a women’s social burden and the case of Islam is not an exception. While religion influences Muslims’ health beliefs, behaviours and decisions, health providers are not always aware of cultural and religious preferences and norms. Thus, Islamic norms on health treatments can result in Muslim’s exclusion from the health care system, especially affecting Muslim women. This can especially impact issues on infertility and reproduction, which holds exceptional moral and social significance across religions. Through an innovative focus, this project aims to advance scientific knowledge about how Sunni Muslims in a minority context in Europe navigate between the authority of medical science and the authority of religion, and to what extent this affect their access to health care.. The project will provide empirical data and develop a theoretical framework based on gender studies, sociology of religion and anthropology of health literatures. This will be achieved by applying intersectional perspective and qualitative methodologies, consisting of semi-structured interviews with Health Professionals and Muslims who have had fertility treatments. The research will be conducted in two European cities: Oslo and Barcelona. Both cities have experienced a rapid increase in religious diversity in last decades but are different in their organisation of religious communities and of health systems. The comparison between the two cities will provide insights into differences among Sunni Muslims around negotiating health, religious and gender issues. This project will contribute to new avenues of investigation concerning the life conditions of Sunni Muslims in Europe and will develop new knowledge on health inequality that may be adapted for future research on other religious minorities or vulnerable groups. 

Multidisciplinary Assessment of Crustacean Sentience

Crustacean sentience (the capacity of this group to experience emotions) has sparked a heated debate across multiple disciplines, particularly as it could impact several major sectors such as fisheries and aquaculture. The outdated argument that animals do not experience negative emotions (such as pain) because they lack conscience, has been proven wrong for vertebrates and some invertebrates (e.g. octopus), but remains controversial for crustaceans. There is evidence of criteria consistent with the idea of pain, as crustaceans have and activate nociceptive pathways, but there is no evidence of the neural pathways integrating the responses nor the demonstration of the awareness thereafter. This is partly due to the ‘dispersed’  central nervous system (CNS) these animals present, with multiple ganglia, but no ‘brain’ as a focal point. To overcome this, MACS aims to apply new technology to measure 9 simultaneous nerve signals (8 ganglia and the heart) to fully understand the nociceptive pathways and how are they integrated in crustaceans’ CNS. This approach will tackle the principle of triangulation by (1) The development of an electroencephalogram (EEG) to record the nervous system of commercially important crustacean species; (2) the characterization of pain and stress through physiological and molecular animal-based indicators; and (3) the evaluation of behaviour and its neurological integration pathway.  As such, this multidisciplinary study will only be possible through a combination of my crustacean stress physiology background, my supervisor’s knowledge of the central nervous system anatomy, and my second supervisor's expertise in aquatic species' EEG. The outcome of this fellowship will range from CNS studies to validate current industrial practices (during a non-academic placement), to socio-economic impacts involving the society's concern for animal welfare. The knowledge and skills gained from this project will allow me to become an independent researcher.

Deciphering Evolutionary Innovations: Comparative genomics of the origin and loss of venom in marine snails

The VENORIGN project aims to understand the evolution of novelty in biology. A major goal of contemporary evolutionary biology is to decipher the molecular basis of major phenotypic innovations in organisms, such as winged flight in birds and echolocation in whales. However, most cases of evolutionary novelty involve complex interactions among multiple genes, each with only minor effects. To address this challenge, we turn to venomous marine snails, specifically the Conoidea group, which includes cone snails and related species. Venom in these snails is linked to a limited set of proteins called toxins, representing the primary genetic changes responsible for the shift from non-venomous to venomous animals. The long-standing interest in cone snail toxins provides a unique context for studying this transition. Yet, the origins of the conoidean venom system and the processes governing multiple venom losses remain poorly understood. This project tests the hypothesis that the origin and loss of conoidean venom resulted from rapid genomic and morphological changes and will investigate these genetic and morphological alterations driving venom's emergence and disappearance. Using cutting-edge methods spanning morphology, taxonomy, genomics, and transcriptomics, we will analyze venomous and non-venomous conoidean and related species. This comprehensive comparison will reveal the processes governing venom acquisition and loss, shedding light on the principles of evolutionary novelty. Our work extends beyond venomous snails, offering a novel model to understand the molecular foundations of significant evolutionary changes. These findings will contribute to our understanding of how novel traits emerge in various biological systems, including human pathogens and agricultural development.

Chemosensation is a critical signalling process for sea cucumbers which relies on the interaction between their chemosensory receptors and various ligands for foraging and reproduction. Although there is a vast amount of research on the chemistry of secreted specialized metabolites of sea cucumbers, and some behavioural data evidencing chemoreception of these metabolites, the chemosensory receptors of these organisms have not yet been identified and nothing is known about the physiology behind sea cucumber chemosensation. This setback is in large part because the scientific approach behind studying chemosensation requires a vast array of techniques and expertise in ethology, chemistry, molecular biology, and biophysics.  Firstly, a behaviour associated with a chemical cue must be quantifiable, secondly, the precise chemical cue eliciting the behaviour response must be identified and isolated, thirdly, the chemosensory receptor of this specific cue needs to be identified on a tissue, cellular, and molecular level, and finally, the activation of this specific receptor by a specific chemical cue must elicit a measurable response on a molecular, cellular, tissue, and organismal level. Through this project, I will elucidate the physiology of chemical communication between sea cucumber by considering these sequential steps in chemosensation. With my previous experience in sea cucumber ethology and chemistry, SensHolo will enrich my skill base in molecular biology and biophysics so that the mechanisms behind intraspecific chemical communication between sea cucumbers may be determined from both the emitter and receiver perspective; from signal to receptor.  This holistic approach will be ground-breaking in chemosensation and sea cucumber research. It will enable future research to address the evolution of chemosensation in marine invertebrates and the chemical ecology of sea cucumbers both in the context of optimizing aquaculture and in their ecological conservation.

Extending Techniques in Wall-Crossing and Enumerative Sheaf Theory

The goal of ExtWest (Applying and Extending Techniques in Wall-Crossing and Enumerative Sheaf Theory) is twofold: First, we plan to find and realize new applications of the recent technical developments in the field of enumerative sheaf theory, thereby proving new groundbreaking results. Second, we plan to develop new techniques inspired by the extisting results, and to thereby extend the range of accessible questions in this research area.

RMIT EU spearheads the Driving Climate Positive Futures (DREAM+PLAN), a truly interdisciplinary, international and intersectoral PhD program, uniting European and Australian research via 32 doctoral positions for double degree.  DREAM+PLAN brings together a community of visionary changemakers, leaders, who dream big and develop tangible pathways for solving local and global climate-related challenges, all united by a mission to create a positive impact, towards a more sustainable, fair, inclusive and thriving planet for future generations.  The need for  1. resilience (ability to withstand and recover from disruptions),  2. restoration (ability to repair or rehabilitate degraded ecosystems) and  3. regeneration (fostering the renewal, revitalization and replenishment of ecosystems, communities)  research is more acute than ever.   The overarching objectives of DREAM+PLAN research training program is to create and deliver, legacy-worthy, novel, cutting-edge, 3i-centric training through best-practice multi-faceted, multi-modal group and individual training options for DCs. Ultimately, breeding the next generation of high-performing ESRs equipped with a unique set of skills and capabilities to fully comprehend and address the multifaceted nature and scale of climate change, across sectors.  DREAM+PLAN’s training program is aligned to contribute to EU Missions, the European Green Deal and supporting RIS3 strategies and includes 3 annual doctoral schools, adopting a novel scaffolding approach.  DREAM+PLAN will fully embrace diversity and through its ecosystem approach, develop pathways for ESRs towards new mindsets, behaviours, technologies, policies supporting the transition to more sustainable, fairer, and productive futures. 

Driving Climate Positive Futures

Due to its multidrug resistance (MDR), Enterococcus faecium (Efm) poses a challenge to the healthcare system and renders most standard antibiotics useless.  Bacteriophage (phage) therapy has resurfaced as a treatment strategy for bacterial infections due to increasing antibiotic resistance. Its advantages include specificity, low side effects and production costs, especially when used in combination with standard-of-care antibiotics.  Phage therapy has been successful in compassionate use, but its wider implementation is hindered by a lack of knowledge on which antibiotics phages synergize and the mechanisms behind remain elusive.  Our project is unique in that it aims to enable the use of conventional antibiotics in MDR Efm through phages. We want to explore which antibiotic classes phages synergize with, which survival strategies Efm uses against phages, and how host factors influence the ability of the antibiotic-phage combination to kill Efm. First, we will investigate phages' interaction with different antibiotic classes against Efm. We will explore the dynamics of phage-antibiotic combinations and whether they are additive, synergistic, or antagonistic. Second, potential phage survival strategies of Efm will be investigated. Additionally, membrane vesicles will be investigated as a potential survival strategy against phages, and their ability to act as a decoy and protect the bacterium from phages will be studied. Third, we will investigate the impact of host factors on the phage-antibiotic killing of Efm, to see whether they can enhance or suppress the phage-antibiotic killing. This approach will provide a deeper understanding of the phages-antibiotic interaction against MDR Efm strains, as well as potential survival systems of Efm which may also shed light on possible mitigation strategies.  Overall, this approach has the potential to enable the use of standard-of-care drugs against MDR bacterial infections in general.

PrepApp: An Embodied Scenes approach for the teaching and learning of English prepositions

Prepositions play a critical role in communicating spatial relations that involve real-world physical entities (e.g., The keys are on the dresser) and abstract concepts (time after time), yet teaching their usage patterns can be tricky (Tyler, 2012). The research question addressed by this project deals with how we can teach prepositions in a systematic way. The purpose of this study is to address five scientific problems surrounding the teaching and learning of prepositions by bridging the divides between: (1) psychology and linguistics, (2) the laboratory and the real world, (3) native speakers and students, (4) educational professionals and accessible tools, and (5) disciplines by bridging a methodological gap via a novel theoretical framework. We can bridge these divides by implementing principles from cognitive psychology that tap into the mechanisms that scaffold thought processes. The main objective is to produce profiles for high frequency prepositions, to build lessons combining these profiles with an Embodied Scenes (ES) framework, and to test the lessons in the classroom. While new methods in preposition teaching are slow to be adopted, research is moving fast. An ES approach that is compatible with Cognitive Linguistics (CL) research may increase traction for preposition course materials. This study would provide data about real world behavior and provide an accessible tool for students.

Co-benefits and synergies between biodiversity conservation, poverty alleviation and climate change mitigation from a social-ecological systems perspective

CoBioPovCli addresses the question of how to conserve biodiversity, alleviate poverty, and mitigate climate change simultaneously, which are interrelated challenges that threaten human and environmental well-being. The importance of this topic is highlighted by the current context of the global COVID-19 pandemic and the Russia-Ukraine war, which have exacerbated these problems and their impacts on human and environmental well-being. The main gaps in this topic are: (1) lack of comprehensive data, especially on the dynamics of socio-ecological systems, (2) lack of integrated knowledge, and (3) lack of holistic approaches that consider co-benefits and synergies. CoBioPovCli aims to overcome the limitations and gaps in the current state-of-the-art by developing an integrated spatial planning approach that can achieve win-win synergies between biodiversity conservation, poverty alleviation, and climate change mitigation from a social-ecological systems perspective.  CoBioPovCli will use literature, models remote sensing data, and other data sources to construct and apply the spatial planning approach, based on case studies, spatial analysis and scenario simulation. CoBioPovCli will generate new knowledge, data and solutions that are conceptually novel, scientifically rigorous and policy-relevant. It will enhance our understanding of the multiple values of biodiversity and its contributions to human well-being under changing climatic conditions. It will provide evidence-based recommendations and best practices for promoting more integrated and sustainable approaches that benefit both people and the planet. CoBioPovCli will also enhance Europe’s scientific and technical capacity and excellence in the field of co-benefits and synergies between biodiversity conservation, poverty alleviation, and climate change mitigation, as well as contribute to Europe’s global leadership and influence in addressing these interlinked challenges.

The project will use advanced mass spectrometric techniques to develop test protocols that can reduce uncertainty in data from special core analysis (SCAL). SCAL is a collective term for certain laboratory tests performed on petroleum reservoir rock (drilling cores) and fluids to determine important reservoir engineering properties. The most basic property at pore scale is the wettability of the reservoir rock with respect to the reservoir fluids. This largely controls the mobility of oil, water, and gas in the pore spaces and thus affects the oil production process.

An ideal requirement for representative and reliable SCAL data is that core samples retain their original wettability when delivered to the laboratory. There is often a great deal of uncertainty associated with this. Common laboratory practice is therefore to clean out all reservoir fluids and possible residues of drilling fluid from the samples by various solvents and attempt restoration of the original wettability by well-controlled re-exposure of the cores to oil produced from the reservoir. Whether original wettability can be restored in this way will be investigated by comparing the mass spectrometric profiles of oil components extracted from the pore surfaces in core samples with the profile of oil produced from the formation. The mass spectrometric techniques to be used allow the determination of the molecular weight of individual oil components with a resolution high enough to identify the element formula of each compound. Comparison of the component profiles of adsorbed hydrocarbons and mobile oil can indicate whether the observed wettability of a reservoir core represents original reservoir conditions or are spuriously influenced by the treatment of the core prior to the SCAL analysis.

More reliable laboratory data will lead to better operational decisions, less risk of failed investments and better chances of optimization, both in terms of extracted oil volume and energy use.

Special core analysis (SCAL) is a set of laboratory procedures to determine essential reservoir engineering properties like oil displacement, permeability and wettability by conducting various tests on reservoir material. These properties – wettability in particular – are important to assess the resources in place, estimate fluid flow characteristics and in developing optimal strategies for hydrocarbon recovery. More reliable laboratory data will lead to better operational decisions, less risk of failed investments, and better chances of optimization, in regard both to oil volumes recovered and energy expended. Wettability is the most basic rock-fluid interaction at pore level. It largely governs the mobility of reservoir fluids and their distribution in the pore spaces and thereby affects oil recovery processes. A fundamental requirement for representative and reliable SCAL data is that core samples retain their original wettability when delivered to the laboratory or that the original wettability can be restored. It is hypothesized that the most surface-active components in an oil, being minority oil components containing elements such as oxygen, nitrogen and sulphur, will adsorb on the rock surface and thus determine the wettability. If originally only present in small amounts these components might not be present in the mobile oil, and if they are removed during core preparation (by use of strong solvents) it will not be possible to restore original wettability. The uncertainties of SCAL related to wettability can be reduced by an increased knowledge about the minority oil components. The hypothesis will be tested on representative reservoir rock and fluid samples. Employment of cutting-edge high- and ultra-high resolution mass spectrometry techniques will be pivotal to the project. Comparison of the compound profiles of hydrocarbons adsorbed to the pore surfaces and oil produced from the relevant reservoir formation will be a key element of the analysis.

Testing the foundations of special core analysis

Det tjuende århundre har blitt kalt "rettighetenes tidsalder". Norge har bidratt til å skape det internasjonale menneskerettighetssystemet. Her hjemme har menneskerettighetene fått en stadig sterkere stilling i politisk ordskifte og i norsk rett. Hvor ste rk stilling bør slike internasjonale avtaler og rettspraksis ha? Spørsmålet reiser en rekke prinsipielle problemstillinger som blant annet har blitt vurdert av Stortinget som i mai 2014 behandlet forslag om endringer i Grunnloven for å styrke menneskerett ighetenes stilling i norsk rett. 

Prosjektet hadde som mål å undersøke hvilken betydning ulike konstitusjonelle forhold har hatt for menneskerettighetssystemets framvekst og betydning. Dette hadde dels en idémessig side: nasjonale konstitusjoner har in spirert dem som har laget utkastene til internasjonale avtaler og erklæringer; og internasjonale dokumenter har inspirert dem som har utarbeidet nye eller reviderte nasjonale konstitusjoner. Det hadde også en prosessuell side - konstitusjoner har ofte bes temmelser om hvordan en stat kan slutte seg til (ratifisere) en ferdig avtale. I tillegg vil konstitusjoner gjerne legge rammer for hvilken gjennomslagskraft en ratifisert avtale får i enkeltland. Begge de siste elementene vil påvirke den rolle enkeltland  tar under internasjonale forhandlinger om menneskerettighetsavtaler og den etterfølgende hjemlige vurderingen av hvorvidt slike skal ratifiseres.

Prosjektet har hatt en hovedvekt på Norge, men det har også hatt komparative elementer. Det ene delprosje ktet har sett på Norges og USAs bidrag til å skape et internasjonalt menneskerettighetssystem, med en hovedvekt på årene 1940-1954. Det andre delprosjektet var en arkiv- og intervjubasert studie av Norges bidrag til framforhandlingen av Den internasjonale  arbeidsorganisasjonen (ILO) sin konvensjon nr 169 Om urfolks rettigheter (1989) og om den etterfølgende ratifikasjonsprosessen. Dette siste prosjektet inkluderte et omfattende muntlig historieintervju med Ole Henrik Magga som vil bli gjort tilgjengelig f or allmenheten på Riksarkivets nettside.




Prosjektet vi foreslår vil studere hvorledes internasjonale menneskerettighetsavtaler ble forventet å påvirke lokale og nasjonale politiske prosesser, og også hvorledes de har gjort det i praksis. I kjernen av dette ligger både strukturelle elementer med  hensyn til hvorledes Grunnloven og etablert praksis la rammer for forholdet mellom nasjonal og internasjonal rett, men også hvorledes sentrale politikere, embetsmenn og aktivister har oppfattet at internasjonal rett er relevant for rettslig og politisk pr aksis i Norge. Prosjektet har en hovedvekt på Norge, men har også betydelige komparative elementer. Framvekst av internasjonal rett og dennes betydning for nasjonale politiske prosesser settes inn en internasjonal historisk kontekst der vi spør om hvordan  økt internasjonal samarbeid i tiden etter 1945 har påvirket marginaliserte gruppers nasjonale politiske gjennomslagskraft. Prosjektet vil ha bred interesse særlig i samiske miljøer, i Finnmark og andre områder som er berørt og også i nasjonale politiske  miljøer. Videre vil de allmenne og komparative perspektivene være relevante for det pågående arbeidet med å revidere Grunnlovens menneskerettighetsbestemmelser. Prosjektet har tre hoveddeler. Det første er en empirisk, arkiv- og intervjubasert studie av N orges bidrag til framforhandlingen av Den internasjonale arbeidsorganisasjonen (ILO) sin konvensjon nr 169 Om urfolks rettigheter (1989). Dette delprosjektet inkluderer publiseringen av en vitenskaplig artikkel samt en internasjonal arbeidskonferanse om i nternasjonale menneskerettigheters betydning for pågående politiske prosesser. Den andre er en komparativ arkivbasert studie av Norges og USAs bidrag til å skape et internasjonalt menneskerettighetssystem, med en hovedvekt på årene 1940-1954. Tilslutt har  prosjektet en bred og betydelig formidlingskomponent knyttet til Institutt for arkeologi, konservering og histories 2014 prosjekt 'Norgeshistorie på nett'.

Tillegg fra søknad 227947:

Tilleggsbevilgningen søkes for å kunne gjennomføre et muntlig histori eintervju med Ole Henrik Magga  etter en metode utviklet av Forum for samtidshistorie (FoSam) ved UiO. Vi vil uansett intervjue Magga i forbindelse med vårt delprosjekt om ILO konvensjon 169. En hovedbegrunnelse for endre metode er at intervjuet kan bli e n del av Riksarkivets samling og være tilgjengelig for forskere og allmenheten, se http://www.arkivverket.no/Aktuelt/Nyhetsarkiv/Politikk-fra-innsiden.
I alt 41 sentrale samfunnsaktører ble intervjuet av FoSam som ledd i dets prosjekt om endringer i norsk  politisk kultur etter 1975. Ingen av disse var samiske. I denne perioden skjedde imidlertid store endringer i forholdet mellom den norske og samiske befolkning og mellom den norske stat og samene.  Et intervju med Magga vil dekke sentrale tema i norsk og  samisk politisk historie de siste femti-seksti år. Dette inkluderer Altasaken, opprettelsen av Sametinget, henvisningen til samene i Grunnloven og framforhandlingen av Finnmarksloven.  Vi vil også berøre samisk internasjonal aktivisme og betydningen av i nternasjonale menneskerettighetsinstrumenter for samiske politiske krav i Norge. Intervjuet vil være et viktig tillegg til Riksarkivets samling. 
FoSam-intervjuene har resultert i lydopptak på 3-6 timer/70-100 sider redigert tekst. Intervjuet med Magga fo rventes å få et omfang på 5-6 timer. Metoden er beskrevet i vedlegget.
En endring i intervjuform vil utløse ekstrakostnader. Det må utarbeides en dokumentasjonsmappe som vil ligge til grunn for intervjuet. I tillegg må intervjuet transkriberes og redigere s. Vi ønsker å bruke ekstern kvalitetssikring og én ekstern intervjuer i tillegg til Vik og Semb. 
Intervjuobjektet kan velge å klausurere hele eller deler av materialet. Et flertall av de intervjuede har imidlertid valgt å godkjenne rask publisering av h ele eller deler av intervjuet på Riksarkivets nettside. Vi ønsker å intervjue Magga i mars 2013 og ferdigstille intervjuet i september.

Det globale i det lokale og det lokale i det globale - konstitusjon, menneskerettigheter og interessekamp.

The one day of constituional debate in 1814 gives us a unique intake to study changes both at the macro-political and the micro-political levels. On the one hand, the debate crystallises paternalist, loyalist and democratic positions, among civil servants  who were transforming from being archetypical middle-men of empire to a class of increasingly self-aware leaders of the country. On the other, it also highlights the quotidian practices that enabled such change. The suggested project thus aims at studyin g the change from empire to suzerainty through three different loci. At the macro-level, we seek to establish the Dano-Norwegian monarchy as one of many empires of the day, and Norwegian independence in 1814 as one example of imperial dissolution. At the  micro-level, we study how this transition was interconnected with the growing self-awareness and changing practices of the Norwegian civil servants. Tying the levels together, at the meso level, we study how changing conceptualisations of external affairs  and Norway's relations with the world around it opened conceptual space for suzerainty and gradual democratisation.

It is important to acknowledge that this is a social science project rather than an historical project. The vast body of literature on Sc andinavian history from the period will be mined and reassessed through social science lenses as a means, on the one hand, of bringing new aspects of the historical period around the Constitution to light and on the other of extending our theoretical unde rstanding of different polities, state formations and the mechanisms behind them. The project is an extension of ongoing research, and will rely on first-hand sources and on second-hand sources in the Scandinavian languages and English. We will rely on de tailed readings of key works of central authors, journals and newspapers of the day and Storting records. Content analysis and network analysis, both quantitative and qualitative, will be used.

I forbindelse med vårt prosjekt Manning the State, søker vi  om midler til deltakelse på seminar i Danmark 30.-31. januar 2012, samt i denne  forbindelse å avholde seminar i København 1. februar.  

Vi ønsker å koble oss opp til det danske 1814 nettverket gjennom å bidra på en av konferansene de avholder. Konferansen er særdeles relevant for vårt prosjekt, da den omhandler ?Norge, hertugdømmer ne og kolonierne - 1814 og eftervirkningerne?. 

Vi ønsker å kombinere vår deltagelse i 1814 nettverkets konferanse, med et prosjektseminar i København i etterkant. Vi vil her presentere de første artikkelutkastene, som vil raffineres videre etter innspil l fra referansegruppen for presentasjon på en internasjonal konferanse i San Diego senere samme vår. Dette seminaret vil dermed være første skritt i prosessen frem mot de første artiklene.

Dette kombinerte tiltaket er dermed tuftet på både samarbeid mell om prosjektene i GRUNNLOV og 1814 nettverket, og faglig assistanse iht. spesifisering av referansegruppe i den opprinnelige prosjektsøknaden.

MANNING THE STATE:  The Danish Empire, Its Norwegian Civil Servants and the Making of the 1814 Constitution

Året 2014 har markert at det er 200 år siden Grunnloven ble til og dannet startpunktet for et nytt og selvstendig Norge. Denne boken tar opp et tema som ikke var så mye fremme i jubileumsåret, nemlig forholdet mellom Grunnloven og den norske velferdsstaten. Bokens hovedtema er den gradvise utviklingen gjennom hele tidsspennet fra 1814-2014; fra liberal rettsstat til sosial retts- og velferdsstat. Begrepet «velferdsstat» var helt ukjent i 1814, og 1814-Grunnloven sa naturlig nok ingenting om sosiale rettigheter. Men Norge er i dag en velutviklet velferdsstat, flere ganger kåret til et av verdens beste land å leve i. Og det til tross for at velferdsgoder ikke har vært vernet av Grunnloven. Prosjektet har vært drevet frem av en nysgjerrighet knyttet til om, og eventuelt på hvilken måte, Grunnloven likevel har hatt betydning for utviklingen av den norske velferdsstaten. Er det overhodet noen sammenheng? Vårt prosjekt har bygget på en hypotese om at det må finnes noen sammenhenger mellom Grunnloven og velferdsstaten, men at disse ikke nødvendigvis er åpenbare. 
Vi festet oss tidlig ved særlig én nokså klar normativ sammenheng, eller «rød tråd», som binder fortid og nåtid sammen, nemlig likhetsprinsippet. Dette prinsippet kommer til uttrykk i 1814-Grunnloven, og det er en av grunnverdiene i velferdsstaten. I Grunnlovens ideer om folkesuverenitet, likhet og menneskerettigheter går det en tråd fra Grunnloven av 1814 til dagens norske velferdsstat. Det er grunn til å tro at den normative røde tråden om folkesuverenitet, likhet og menneskerettigheter har preget det norske samfunnet, og at dette gir grunnlag for en konklusjon om at Grunnloven har hatt betydning for utviklingen av velferdsstaten. 
Boken anlegger et prosessuelt og idémessig perspektiv for å få fram de store linjene i utviklingen fra enevelde, rettsstat, demokrati og velferdsstat, som glir over i og overlapper hverandre. I tillegg har den et tematisk og tverrgående perspektiv eller omdreiningspunkt knyttet til Grunnloven som en overordnet «samfunnskontrakt» mellom staten og borgerne. Et sentralt spørsmål i boken er om Grunnloven gir et adekvat uttrykk for den moderne norske samfunnskontrakten.
Grunnlovens § 2 - tidligere kjent som «jødeparagrafen» - var den mest kjente og omdiskuterte paragrafen i 1814-grunnloven. Historien om denne bestemmelsen og de endringer den har gjennomgått i løpet av 200 år, er samtidig en fortelling om norsk samfunnsutvikling og synet på de fremmede. Fortidens debatter om Grunnlovens «jødeparagraf»  gir gjenklang til dagens debatter om innvandring, integrering og eksklusjon. 
De lange linjene fra 1814 til 2014 viser at mye er forskjellig, men at det likevel er bånd mellom fortid og nåtid, og at Grunnloven knytter forbindelser mellom fortid og nåtid. Et viktig spørsmål i dag er hvilken rolle Grunnloven bør ha i å beskytte sentrale velferdsgoder og marginaliserte grupper og i å gi vern mot en mulig fremtidig nedbygging av velferdsstaten.
I mai 2014 ble Grunnlovens menneskerettighetsvern oppgradert. Statens menneskerettslige plikt til å verne om velferdsgoder har nå fått et konstitusjonelt uttrykk. Det gjelder barns særlige rett til økonomisk, sosial og helsemessig trygghet (§ 104), rett til utdanning (§109) og rett til stønad til livsopphold for den som ikke kan forsørge seg selv (§ 110). Vern om helse og rett til nødvendig helsehjelp (for voksne) ble ikke tatt med. Dette kan kritiseres i lys av at befolkningens helse, i likhet med utdanning, har vært et satsingsområde for Norge helt siden 1800-tallet.  Selv om de nye grunnlovsbestemmelsene ikke medfører materielle endringer i gjeldende norsk rett, har de likevel betydning: Grunnloven, forstått som en overordnet samfunnskontrakt mellom staten og folket, gir nå et mer dekkende uttrykk for de krav og forventninger som gjelder mellom staten og borgerne i dagens Norge. 


This project explores the influence of the Norwegian Constitution on the notion of citizenship, and in particular the legal and political interplay between the Constitution and the development of the Norwegian welfare state. The notion of a social contrac t is of particular interest: What kind of social contract was established between the Norwegian state and its citizens with and by the 1814 Constitution? Might the egalitarian way of thinking, as expressed in the 1814 Constitution (prohibition of future l ordships, baronies and other aristocratic institutions) be seen as an important stepping stone for the development of the Norwegian welfare state and model of citizenship? The 1814 Norwegian Constitution contained provisions forbidding Jews, Jesuits and m onk orders access to the kingdom, thereby signifying a need to protect Norwegian society against particular foreign influences. What is the relationship between this protectionist attitude, egalitarianism and current modern welfare state policies and regu lations when it comes to immigrants?  

Norway has developed a strong welfare state built on universal social benefits. However, social rights are not protected as such in the Constitution. Thus, it seems that the Norwegian Constitution is not representat ive of the basic values and principles that characterize Norwegian society today. Based on this and other observations, the project will examine the relevance of the Norwegian Constitution for today´s national and international legal debates, and analyze  the Norwegian Constitution in a comparative perspective with regard to content, structure and aims. Our ambition is to examine the Constitution in three contexts: The modern welfare state, international human rights and comparative law. All these contexts  are essential for the understanding of the Norwegian Constitution and its status as the normative framework and legal infrastructure in Norway.

Tillegg i forbindelse med søknad nr. 208381:
Symposiet har til føremål å kombinere grunnlovsdebatt for eit allmeint publikum med rettsvitskapeleg gransking av aktuelle grunnlovsspørsmål og er det fyrste av tre slike planlagte satsinga r frå Det juridiske fakultet fram mot 1814. Tema for den fyrste dagen av dette fyrste symposiet er «Grunnloven og menneskerettighetene 1814-2014». Bakgrunnen er at Stortingets menneskerettsutval leverer sitt framlegg til revisjon av menneskerettane i Grun nlova i januar 2012. Innstillinga frå Menneskerettsutvalet vil bli presentert for eit allmeint publikum og deretter, truleg for fyrste gong, diskutert av leiande norske fagpersonar (sjå vedlagt program).
På andre dagen av symposiet blir det rettsvitskapel ege perspektivet frå spørsmålet om revisjonen av menneskerettane i Grunnloven utvida til å omfatte andre aktuelle forfatnings-spørsmål. Dagen opnar, med forankring i diskusjonen frå fyrste dag, med ein presentasjon og diskusjon av dei sentrale forskingssp ørsmåla i «Grunnloven og velferdsstaten» som er fakul-tetets prosjekt under NFRs grunnlovssatsing. Programmet held vidare fram med tre tema som går på demokratiske utfordringar og dilemma i det norske samfunnet, jf. hovudtema 2 i den faglege planen for Gr unnlovssatsinga. Konkret er det den konstitusjonelle utviklinga i kom-parativt perspektiv, spørsmålet om grunnlovsfesting av kommunalt sjølvstyre og den for-fatningsrettslege stillinga til Noregs Bank som blir sett på agendaen i dette fyrste av tre planla gde symposium. 
Symposiet tek sikte på å nå ut til eit allmeint publikum med diskusjonen om revisjonen av menneskerettane i Grunnloven. I den breiare diskusjonen av demokratiske utfordringar og dilemma knytt til forfatninga på andre dagen av symposiet, er  målet fyrst og fremst å generere rettsvitskapeleg forfatningsforsking av høg kvalitet innanfor område som i liten grad blir handsama under hovudprosjekta i NFRs Grunnlovssatsing.

Symposiet har til føremål å  kombinere grunnlovsdebatt for eit allmeint publikum med rettsvitskapeleg gransking av aktuelle grunnlovsspørsmål og er det andre av tre slike planlagte arrangement frå Det juridiske fakultet fram mot 1814. Arrangementet er programmert etter same lest som  i fjor då meir enn 100 forskarar, byråkratar, studentar og politikarar fann vegen til symposiet. Tema er i år «Grunnlov, likskap og demokrati» og symposiet vil under denne tittelen løfte fram så vel rettshistoriske som dagsaktuelle problem som Grunnloven  tek sikte på å regulere.

Første del av symposiet har i år eit rettshistorisk perspektiv og tek utgangspunkt i likskapstanken frå 1814. Likskapstanken og prinsippet om folkesuverenitet vil her bli sett inn i ein historisk kontekst. Ved hjelp av rettsforsk arar og historikarar skal vi, i dialog med publikum, trekkje linjer bakover og framover i tid.

Constitution, welfare state and citizenship

Verdenskongressene i konstitusjonell rett arangeres hvert 4. år av International Association of Constitutional Law (IACL). Kongressene har gjerne 500-600 deltagere (både etablerte forskere og rekrutter) og tilbyr et prestisjefyle forum for forskningsformi dling og -debatt i konstitusjonell rett (statsforfatningsrett). Det er en selvfølge at viktige deler av programmet legges opp rundt temaer som er relatert til det norske 200-årsjubileet. 
Ideen om å legge kongressen i 2014 til Oslo er klarert med IACL på  en slik måte at en invitasjon fra UiO utvilsomt vil bli akseptert. En invitasjonen forutsetter imidlertid at den nødvendige sikkerhet kan etableres for at de økonomiske og praktiske vilkårene vil la seg tilfredsstille. Dette bør så vidt mulig skje før eks ekutivkomitémøtet i IACL i Paris 9. oktober og senest i tide for neste verdenskongress 5.-10. desember 2010, der den planlagte invitasjonen formelt må fremmes og aksepteres av IACL. 
For å få til dette er vi avhengige av å kunne subsidiere kongressen med  et betydelig beløp. Norge er (kjent som) et høykostland, og det er viktig at kongressen ikke prises slik at forskningsrekrutter samt deltagere fra fattige land i praksis blir utestengt. Slik budsjettet foreløpig er satt opp, vil det bli krevet betydelig h øyere deltageravgift enn normalt (200 euros). Kongressen kan ikke fullfinansieres på denne måten uten at prisen gå sterkt utover deltagelsen. 
Siden få andre offentlige finansieringskilder relevante, vil den vesentlige del av finansieringen måtte komme fr a GRUNNLOV-programmet. Det angitte maksimalbeløpet for støtte til arrangementer fra NFR (NOK 500 000) er ikke tilstrekkelig; anvendt på et arrangement av nasjonal interesse og av såpass ekstraordinær karakter virker rammen dessuten vilkårlig. Dersom en ti ldeling likevel begrenses til dette beløpet, vil vi være avhengige av å klare å samle støtte fra flere eksterne kilder. Det er i beste fall usikkert om dette lar seg gjøre innenfor nevnte tidsramme.
