Bymiljøavtaler som redskap for bærekraftig bo- areal- og transportutvikling

Alternative title: Urban Environmental Agreements - A way forward? The negotiations, the coordination and the possible effects.

The aim of this project was to explore the potential of urban environmental agreements/urban growth agreements (hereafter urban growth agreements - UGA) to achieve a sustainable housing, land use and transport development. We have studied: - how UGAs are developed through interaction between national, regional and local authorities, and the challenges and opportunities that arise in this collaboration. - how the UGAs and the processes with their development are coordinated with other regional and local planning processes, and also how this may affect the outcome of the urban environmental agreements. - the barriers to and opportunities for implementation of UGAs and whether the measures included are appropriate for achieving the defined targets. Our results show that urban growth agreements can be a flexible instrument with the potential to increase coordination between the transport and land use sectors to achieve the zero-growth goal in personal transport. Urban growth agreements also have potential as an implementation tool for regional plans by increasing the obligations to follow regional plans at both municipal, regional and state levels. However, the project results also point to the fact that the concept of urban growth agreement faces several challenges that must be solved if the agreements are to serve as a tool for comprehensive housing, land use and transport development. We highlight the following: 1) The suitability of the zero-growth goal to contribute to solving challenges the urban areas face both with respect to reducing climate emissions and limiting transport in the long term. 2) Measures and policy instruments included in the urban growth agreements include measures and policy instruments that both reduce and increase private car use by investing in public transport, bicycle and walking lanes and the construction of new roads. This implies conflicting ambitions in the urban growth agreements and illustrates a lack of consistency in transport policy which poses a clear challenge for agreements. 3) Our study shows that the urban growth agreements increase the coordination of regional plans in the urban area and contribute to a tighter land use policy. However, the agreements do not always manage to constrain the state to follow the intentions of the agreements. In many of the urban areas, localization decisions of the state are potentially in conflict with the goals of the UGAs and is perceived as a challenge in several of the urban areas. 4) The study highlights the democratic challenges of the agreements. Urban growth agreements activate vertical tensions between democratically elected assemblies at local level (municipal council), regional level (county council) and national level (Storting), but also horizontal tensions between different considerations - the desire for effective decision-making on the one hand, and democratic anchoring and ownership of regional and local democratically elected councils on the other. 5) Many of our informants at the local and regional level perceive an asymmetric power balance between the various actors involved in the negotiation process of the agreements. Vertical power structures are evident in that the state, represented by the Norwegian Public Roads Administration, is perceived to have too much power in the negotiations of the agreements compared to the municipalities and the regional level. Furthermore, our study also points to challenges that lie in horizontal power structures in that a small number represents the municipalities in the negotiations whilst there is too little scope for involvement of the locally elected democratic representatives. Horizontal power structures between the Ministry of Transport and the Ministry of Local Government and Modernization also apply. The former is perceived to have more power in the negotiations and in the outcome of these than the latter. To address some of these challenges, we recommend that: - The legitimacy of the agreements must be strengthened by involving the municipal councils more actively in the negotiation processes. This will require the allocation of sufficient time for negotiating the agreements and that these can be adapted to the local context. - The differences between the experience of and resistance to new toll road systems must be understood in light of the differences between the urban areas, and the parties must clarify how this can be handled within the framework of the urban growth agreements - In the negotiation process there is a need for clarification of the speed of implementation of transport measures and the size of these balanced against the desirable level of the toll road fees in the region. - A clear communication strategy must be prepared that explains why urban growth agreements are being implemented and what benefits they can provide for the urban areas.

Prosjektet har bidratt med kunnskap til deltakende samfunnsaktører og andre relevante aktører. Gjennom å følge utviklingen av ordningen og logikken bak byvekstavtalene har forskergruppen bidratt med diskusjon og kunnskapsutvikling hos parter som enten er involvert i byvekstavtalene, aktuelle for avtale eller ikke aktuelle for avtale (mindre byområder). Det siste året har fokuset på byvekstavtaler økt særlig som følge av bompengemotstand. Forskergruppen har mottatt mange henvendelser fra presse og andre interesserte aktører om byvekstavtalekonseptet og har bidratt med sin kunnskap til disse. Anbefalingene utarbeidet i prosjektet har et potensial til å påvirke utformingen av avtalene og avtaleprosessene i den neste forhandlingsrunden for allerede eksisterende byvekstavtaler eller for nye områder som skal forhandle avtaler.

Bymiljøavtaler innebærer at staten, fylkeskommunene og kommunene går sammen om å nå målene nedfelt i Stortingets klimaforlik og i Nasjonal Transportplan. Dette prosjektet har som hovedmål å undersøke hvilket potensial helhetlige bymiljøavtaler har for å oppnå en bærekraftig bo-, areal- og transportutvikling. Forskning på bymiljøavtaler og forhandlinger av disse gir en unik mulighet til å studere samspillet mellom ulike forvaltningsnivåer og hvordan statlige intensjoner om påvirkning av lokal virkemiddelbruk lar seg forene med kommunenes interesser og behov for å oppfylle lokale ønsker og prioriteringer. Vi vil studere hvordan bymiljøavtaler utformes i samspillet mellom statlige, regionale og lokale myndigheter, og hvilke utfordringer og muligheter som oppstår i dette samspillet. Videre vil vi se på samspill og koordinering mellom bymiljøavtaler, byutviklingsavtaler og relevante planprosesser, og hvordan dette kan påvirke utfallet av bymiljøavtalene. Vi vil også adressere implementeringsbarrierer og -muligheter i bymiljøavtalene, og om tiltakene som inkluderes er hensiktsmessige for oppnå målene som er satt. Bymiljøavtalene er en ny måte å ivareta samspillet mellom forvaltningsnivåene på. Det er lite erfaringer både internasjonalt og nasjonalt med denne typen av styringsverktøy og tiltakspakker. Vitenskapelig er det derfor viktig å få fram kunnskap om dette styringsinstrumentet. Prosjektet vil gjennomføres i samarbeid med samfunnsaktører, og vil inkludere flere sentrale parter i en referansegruppe. KS, ROM Eiendom og Helsedirektoratet vil også delta i prosjektet med egen arbeidsinnsats og direkte finansiering. Med den aktive brukerinvolveringen som er planlagt i prosjektet, vil vi sikre at partene som involveres bygger opp kunnskap i egen organisasjon, at relevant kunnskap som disse aktørene besitter tilflyter prosjektet, og at resultatene fra prosjektet raskt formidles til aktørene. Prosjektet vil ha en varighet fra 01.09.16 - 31.08. 2019.
