The project will study how the Norwegian County Social Welfare Boards maintain children´s rights to participation in procedures conducted by the Boards. Children´s right to participation is regulated in both Norwegian and international law. As the initial decision body in child welfare cases, the County Social Welfare Boards have extensive experience with children´s participation. Children´s participation is a focus area for the Boards, and several measures have been initiated to increase focus on this matter. This project is linked to another project financed by the Research Council of Norway where the Boards participate in a partnership – “Children´s Right to Participation” at the UiB. The overall goal of the project is to expand the theoretical and empirical knowledge base on children´s right to participation in proceedings affecting them. To achieve this goal, the project will clarify the content and scope of the Child Welfare Act section 6-3 by analyzing sources of national and international law. By case studies of the County Social Welfare Boards´ practice, the project will analyze how the right to participation is practiced by the Boards. On this basis, the project will examine the need for exceptions from an almost unconditional right to participation, and the legal leeway for such regulation. Despite the fact that the right to participate concerns a large number of children, the theoretical and empirical knowledge of its content, practice and significance is limited. The project seeks to obtain new and updated knowledge in an important area within child welfare law. The knowledge provided by these studies will have transfer value to other regulations and fields of practice where children are given a corresponding right to participation. The project will conduct the mentioned investigation of the County Social Welfare Boards´ practice. The project will furthermore use data from the Boards case proceeding system and data obtained by others.

Prosjektets tema er barns rett til medvirkning i saker som behandles av fylkesnemndene. Doktorgradsprosjektet er knyttet til prosjektet Children's right to participation (PARTICIPATION) som ledes av professor Marit Skivenes ved Samfunnsvitenskapelig fakultet, UiB. Doktorgradsprosjektet vil klarlegge innholdet i og omfanget av medvirkningsretten gjennom analyser av nasjonale og internasjonale rettskilder. Gjennom undersøkelse av fylkesnemndenes praksis vil prosjektet belyse hvordan nemndene praktiserer reglene om barns medvirkning, samt kartlegge om og når behovet for unntak fra medvirkningsretten gjør seg gjeldende. Prosjektet vil videre vurdere om nemndenes saksbehandling er i tråd med regelverket og om det er behov for endringer i regelverk og/eller praksis. Kunnskapen om hvordan medvirkningsretten praktiseres og effektene av denne er begrenset. Det finnes ikke tidligere forskning knyttet til behovet for unntaksregel. Prosjektet vil derfor bidra med ny, oppdatert og viktig kunnskap for både praksisfeltet, akademia og lovgiver. Kunnskapen prosjektet tilfører vil ha overføringsverdi til andre regelverk hvor barn er gitt tilsvarende rett til medvirkning. Prosjektet vil dermed ha betydning for forståelsen og utforming av regelverket både i barnevernloven og andre lover, samt for hvordan nemndene og andre instanser hvor barn medvirker, tilrettelegger for og gjennomfører retten til medvirkning i praksis. Prosjektet vil også svare ut behovet for forskning på medvirkningens betydning for resultatet i en barnevernsak slik Folkehelseinstituttet har etterlyst. Prosjektet er dels rettsdogmatisk og dels rettssosiologisk. Praksisgjennomgangen bygger på egen og andres undersøkelser, samt data fra nemndenes saksbehandlingssystem. Data i egen undersøkelse innhentes primært ved gjennomgang av saksdokumenter. Data innhentes på en måte som sikrer anonymitet for de involverte.
