EWS. The outlooks of the Nordic dispute resolution - The future of civil litigation

The seminar series will consist of three workshops. The topics are as follows: 1) The Mediation and the role of courts 2) The obstacles in civil proceedings 3) The Scandinavian court culture in progress. The first workshop will discuss the alternative dis pute resolution and its effects to the court culture. The second seminar will discuss what kind of obstacles there are in the Nordic countries to achieve the access to court and justice in the best way. The third seminar will reassess the Scandinavian leg al culture de lege lata and de lege ferenda. The last seminar will answer the questions from where we are coming and going to at the field of civil litigation. The background of the series is that before the European integration the Nordic countries use d to cooperate in a very effective way among legislative matters. This kind of cooperation has become lowered after the European integration, where Sweden, Denmark and Finland are member states. Norway and Iceland are not member countries and even Denmark has very often followed its own policy in EU. Therefore the Nordic cooperation still has its role in legislative matters. The European culture varies very much. The Scandinavian legal family is, however, still quite homogenous and therefore also unique . For these reasons, the comparative workshop on dispute resolution would be very fruitful. If the comparative studies are made at the Nordic level, it is also possible to go into details. The reason is simple: The similar legal and societal culture. Wh at the status of state courts, the future of civil proceedings and the outlooks of the Nordic dispute resolution is concerned, the situation has been dramatically changed during the latest decades and it also varies in each Nordic country. Even if there h ave recently been huge civil procedural reforms in Nordic countries, the current problems and main trends are not identical. There are space and need for discussions.
