Childrens right to health

Hovedspørsmålet i prosjektet er hvordan barns rett til høyest oppnåelig helsestandard (FNs barnekonvensjon art. 24), heretter kalt retten til helse, kan sikres og gjennomføres ved bruk av juridiske virkemidler. Det primære målet er å sikre barns rett til helse, ved å balansere deres rett til deltakelse og beskyttelse, og balansere foreldrenes og barns rettigheter og plikter, og statens ansvar. Helse er en avgjørende faktor i barns oppvekst, og spiller en kritisk rolle for hvordan barns livsløp utvikler seg. Lovgivningen spiller en viktig rolle i å fremme retten til helse. Vi vil kritisk analysere det rettslige rammeverket, herunder internasjonale konvensjoner, Grunnloven og annen intern norsk rett. Helse og utdanning er to rettigheter som sees i sammenheng i prosjektet. Noen barn er i en spesiell sårbar situasjon, og prinsippet om lik rett til helse kan bli utfordret. To eksempler: Barn i barnevern har økt forekomst av helseproblemer, sammenlignet med resten av barnepopulasjonen. Barn med uavklart oppholdsstatus i Norge er en annen utsatt barnegruppe. Vi vil undersøke om og hvordan det er mulig å bruke juridiske verktøy for å avhjelpe deres sårbarhet i helsemessige forhold. Befolkningen i Norge blir stadig mer heterogen med hensyn til kulturell bakgrunn, religion og livssyn, noe som har konsekvenser for viktige og organisatoriske spørsmål knyttet til helsehjelp for barn, likebehandling, for forholdet mellom barn og foreldre og for hvordan foreldreansvaret utføres. En intensjon med prosjektet er å utvikle en teoretisk modell for hvordan man kan forstå barns rett til helse, innenfor et nordisk velferdsstatsperspektiv. Siktemålet er at en slik modell senere kan være av generell verdi for forskning på andre barnerettslige områder.

This project will investigate how society, by using various legal instruments, can safeguard ‘the right of the child to the enjoyment of the highest attainable standard of health’ (UN Convention on the Rights of the Child art. 24), hereafter called the right to health. The primary objective is to safeguard children’s rights in health matters balancing participation and protection, and balancing the rights and duties of the parents and children’s rights, and the responsibility of the state. Health is a decisive factor in the formative conditions for children, which play a critical role in outcomes during the life cycle. The international and national legal framework on health care for children is crucial as law plays a vital role in advancing the right to health. The character, meaning and consequences of the new provision in the Norwegian Constitution on children’s rights to health, needs to be analysed and questioned. Some children are in a special vulnerable situation and the principle of equal rights to health may be challenged. Two examples: Children in child welfare services have an increased incidence of health problems, compared to the rest of the child population. Another cause of concern is children with unclarified residential status in Norway. The project will investigate if and how it is possible to use legal tools in order to promote their resilience towards discrimination in health matter. The population in Norway is becoming increasingly heterogenic with respect to religion, cultural background and view of life, which has consequences for substantial and organizational questions related to health care for children, equal treatment, for the child/parent dimension and for how the parental responsibility is carried out. The project will develop a theoretical model on how to understand children’s rights in health law from a Nordic welfare state perspective. This model might later be of general value for research on other child-oriented legal domains.
