EØS-finanstilsyn - en rettsvitenskapelig analyse om Norges tilknytning til EUs tilsynssystem for finansmarkedet

The project has analysed Norway's affiliation to the European Financial Supervisory System, agreed upon in 2016 after long and difficult negotiations. The EU refused to grant the EFTA States full membership in the EU Agencies, but accepted them as members without voting rights. The EU nonetheless accepted that any binding decision addressed to public authorities or market operators from the EFTA States will be made by the EFTA Surveillance Authority based on drafts by the EU Financial Supervisory Authorities, and that any judicial review of them will take place in the EFTA Court. The regulations establishing the EU Financial Supervisory Authorities, with the agreed adaptations, were incorporated into the Agreement on the European Economic Area through several decisions by the EEA Joint Committee in the autumn of 2016 and thereafter implemented into Norwegian law, i.a. through a separate Act on EEA Financial Supervision. Still, the compromise reached has left several questions unanswered, in particular related to settlement of disputes between the financial supervisory authorities of an EFTA State on the one hand and those of an EU State on the other, or between the EFTA Surveillance Authority and one of the EU Agencies, as well as judicial protection for private market operators. Further, from the perspective of Norwegian law, difficult questions concerning constitutional, administrative and procedural laws has called for attention. On this background, the project has analysed Norway's affiliation to the European Financial Supervisory Authorities - the European Securities and Markets Authority (ESMA), the European Banking Authority (EBA) and the European Insurance and Occupational Pensions Authority (EIOPA), as well as Norway's participation to the European Systemic Risk Board (ESRB). The analyses are of relevance to the functioning and future development of Norway's integration into the emerging EU system for supervision of financial services within the internal market. Prosjektet tar sikte på å etablere en prosjektgruppe ved Det juridiske fakultetet, UiB, bestående av professor Halvard Haukeland Fredriksen (prosjektleder), en postdoktorstipendiat (2-årig) og 3 studentstipendiater. Med faglig støtte fra fakultetets eksisterende fagmiljøer innen statsrett, forvaltningsrett, markedsrett og prosessrett, samt miljøet ved Senter for Europarett ved UiO, skal prosjektgruppen kartlegge, analysere og vurdere Norges rettslige tilknytning til EUs nye tilsynsstruktur for finansmarkedene i Europa. Det er snakk om et rettsvitenskapelig prosjekt, hvor etablerte norske, EU-rettslige og EØS-rettslige tolkningstradisjoner vil bli anvendt for å analysere den fremforhandlete EØS-tilknytningen til EU-tilsynene fra ulike perspektiver - statsrettslig, forvaltningsrettslig, prosessrettslig, EØS-rettslig og EU-rettslig. Prosjektets hovedbestanddel er et postdoktorprosjekt som skal resultere i 3 vitenskapelige artikler som publiseres i ledende, fagfellevurderte tidsskrift. Postdoktorprosjektet vil bli understøttet av tre studentstipendiater som vil ta for seg utvalgte underproblemstillinger og dermed bidra med grunnlagsmateriale for postdoktorstipendiatens undersøkelser. Til dette kommer prosjektleders bruk av en betydelig del av egen forskningstid til prosjektet, noe som vil lede til ytterligere 2 vitenskapelige artikler hvor EØS-tilknytningen på finansmarkedsfeltet vil bli satt inn i en større sammenheng hvor også norsk tilknytning til andre EU-tilsyn på andre rettsområder vil inngå. Over en periode på 3 år vil prosjektet produsere flere rettsvitenskapelige arbeider som vil kaste nytt lys over Norges tilknytning til EU på finansmarkedsområdet.
