The project explores criminal intent from a functionality perspective, and the main topic is the substance and function of criminal intent in Norwegian criminal law. The Norwegian criminal legislation requires - in several different contexts and forms - t hat the offender has acted intentionally or with a further intention, as conditions for criminal liability. Both the content and the effect of such terms, and how such terms work or possibly could work in different contexts in criminal law, will be analys ed.
The main purpose of the dissertation is to contribute to ensuring the foreseeability and legal safety by increasing the standards to which the "subjective" criteria for punishment is determined.
